Amazon Design Patent Complaint: What to Do Next
How a design patent complaint reaches you
A rights owner submits a report through Amazon's Report a Violation tool, naming the ASINs. You are notified, the listing or offer is typically suppressed, and the complaint appears in your Account Health dashboard with a deadline. From your side the practical effect is immediate: sales stop and ranking decays, so the clock matters more than the paperwork.
The APEX point most sellers get wrong
Amazon's Patent Evaluation Express is a neutral evaluation programme in which an independent attorney assesses a patent infringement claim against specific ASINs. As it currently stands, eligibility is limited to owners of registered US utility patents, and the programme is not available outside the United States. Design patents are not part of it.
That changes the shape of the dispute. For a utility patent complaint there is a defined route with a neutral decision-maker and a known fee structure. For a design patent complaint there is no equivalent neutral evaluation: the listing is simply removed unless the complaint is withdrawn or you substantiate a position that Amazon accepts. That is why design patent complaints so often end in either a retraction by the complainant or a legal opinion from your side.
The first 48 hours
- Do not admit infringement. Not to Amazon, not to the complainant. Statements become part of your account history.
- Get the patent number. The notice should identify the right and the owner. If it does not, ask the complainant directly — their contact details appear in the notification.
- Pull the patent and read the drawings. Check which parts are solid lines and which are broken, since broken lines are not part of the claim.
- Compare appearance, not function. Put your product photos next to the patent figures at the same angles. Note every visible difference and where your product sits relative to what came before.
- Check the dates and the status. When was the patent filed and granted, and is it still in force? For the US, a design patent filed on or after 13 May 2015 runs 15 years from grant — see how long design patents last.
- Preserve your own evidence. Supplier specifications, purchase records, product photos and dated design files, in case you need to show independent development or prior use.
Your realistic options
- Substantiated non-infringement. A documented comparison showing your product differs from the claimed design where it matters most.
- Seek a retraction. A complainant who filed on weak grounds can withdraw the complaint; a written opinion from a registered patent attorney is often what prompts that.
- Invalidity arguments. Prior designs that predate the patent can be relevant.
- Business resolution. A licence, a settlement, or a design-around for future inventory.

Most complaints arrive after a product is already selling.
